1. To Enter. To enter you must pre-register for the land auction that will take place on April 20, 2008 located at New York Marriott at the Brooklyn Bridge, Grand Ballroom 333 Adams Street, Brooklyn, New York, USA 11201 (the “Event”). Pre-registration begins at March 20, 2008 and ends 6:00 A.M.ET April 20, 2008 (“the Pre-Registration Period.”). There is no fee required to complete the pre-registration; you must simply provide a completed pre-registration form or pre-register online at www.landauction.com. All mailed pre-registration forms must be received by the end of the Pre-Registration Period to be eligible for the Drawing (“the Drawing”).  Only pre-registrations received during the Pre-Registration Period will be considered eligible for the Drawing.  Pre-registration entries will not be accepted on the day of the Event. On day of Event, you must provide proper identification that shows you are the individual that pre-registered. To enter the Drawing and have a chance of winning you are not required to be an active participant at the Event by placing any bids during the auction. You must be present at the Event when the Drawing takes place to be eligible to win and claim any prize. There is a limit of one pre-registration per person for the Event. If the Drawing is not capable of being conducted as described in these Official Rules, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify or suspend the Drawing. In such an event, Sponsor reserves the right to choose winner from all eligible entries received. Mutilated entries will not be accepted. Multiple or duplicate entries received will be disqualified. Responsibility for receipt of entry rests solely with the entrant. All entries become the property of the Sponsor. Sponsor will not return or acknowledge receipt of entries.

2. Eligibility. Only open to residents of the 50 United States,(excluding Florida), who are 18 years or older as of April 20, 2008. Void where prohibited or restricted by law. Employees of Sponsor and its affiliates, its dealers, its advertising and promotional agencies, its judging organization, manufacturers or distributors of Drawing materials and their immediate families in the same household are not eligible. All federal, state and local laws and regulations apply.

3. Prize Details. One (1) prize winner will be selected at approximately one o’clock (1pm) local time during the Event that will receive one (1) vacant parcel of land selected at Sponsor’s sole discretion. All property taxes, association dues, utility bonds, assessments, recording fees or any additional costs or fees are the full responsibility of the prize winner. The parcel is provided “as is” with no warranty of any kind, express or implied. Prize is subject to all existing covenants, conditions, restrictions, rights of way, assessments, zoning and any and all other land use restriction. Prize is subject to availability and cannot be transferred, substituted or redeemed for cash except at Sponsor’s sole discretion. Federal, state and local taxes are the responsibility of the winner. Sponsor reserves the right to substitute a prize with a prize of equal or greater value. Approximate retail value of the prize is Five Thousand Dollars ($5,000.00).

4. Drawing and Awarding of Prize. Winner of prize will be determined in random Drawings from all entries received. Drawing will be held by Sponsor whose decisions are final on all matters relating to this Drawing. Odds of winning are determined upon the number of entries received. Winner of the Drawing will be immediately notified by an announcement after the Drawing. If potential winner cannot be reached within five (5) minutes from the first notification attempt, then such person shall be disqualified and an alternate winner may be selected. Winner will be required to sign an affidavit of eligibility and liability/publicity release within one (1) hour after notification, or prize will be forfeited and awarded to an alternate winner. Winner will also be required to execute any and all contract documents within one (1) hour after notification.

5. Data Collection. Sponsor collects personal information from you when you enter the Drawing and by providing your email address you consent to receive emails from Sponsor. The information collected is subject to the privacy policy of Sponsor at www.landauction.com and you may unsubscribe from receiving future emails.

6. Limitation of Liability. Winners agree that (except where prohibited) Sponsor may use winner’s name, picture, portrait, likeness and voice for advertising and promotional purposes without further compensation. Sponsor, its promotional and advertising agencies, and all respective officers, directors, employees, representatives and agents shall have no liability and shall be held harmless by winner for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation in this Drawing. Any and all disputes, claims and causes of action arising out of or connected with this Drawing, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Drawing, but in no event attorney’s fees. Venue shall be in Orange County, California. The Drawing is governed by, and construed in accordance with, the laws of the State of California. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Drawing should non-authorized human intervention or other causes beyond the control of sponsor corrupt or impair the administration, security, fairness or proper play of the Drawing. Sponsor may prohibit an entrant from participating in the Drawing or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Drawing by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. Caution: any attempt by an entrant to undermine the legitimate operation of the Drawing may be in violation of criminal and civil laws and should such an attempt be made, sponsor reserves the right to seek remedies and damages (including attorney’s fees) from any such entrant to the fullest extent of the law, including criminal prosecution. Offer is void where prohibited and subject to federal, state and local laws.

7. Winners List/Rules. For a winners list or a copy of the Official Rules, send a stamped, self-addressed envelope for receipt by April 22, 2008, to Sponsor c/o LandAuction.com Pre-Registration Free Land Drawing, One Mauchly, Irvine, California 92618.
